1. Agreement to These Terms
Welcome to House of PepsiCo. These Terms of Service ("Terms") govern your access to and use of houseofpepsico.com (the "Site") and any purchase you make from us. By browsing the Site or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site or place an order.
We may update these Terms from time to time (see Section 18). Your continued use of the Site after we post changes means you accept the updated Terms.
2. Who Can Use the Site
By using the Site or placing an order, you confirm that you are at least 18 years old, or that you are using the Site with the involvement and consent of a parent or legal guardian. You also confirm that the information you provide to us is accurate and complete, and that you will keep it up to date.
3. Guest Checkout
Our store uses guest checkout; you do not need to create an account to place an order. You are responsible for providing accurate contact, billing, and shipping information at checkout, and order updates will be sent to the email address you provide. Contact us right away at support@houseofpepsico.com if you believe an order has been placed using your information without your permission.
4. Products, Pricing, and Availability
We work hard to display our products and prices accurately, but we cannot guarantee that every detail is error-free.
- Colors and appearance. Product photos are for illustration. Actual colors may vary slightly depending on your screen, and small variations between items are normal for the way our products are made.
- Availability. All products are subject to availability, and we may change, limit the quantity of, or discontinue any product at any time.
- Pricing. Prices are shown in U.S. dollars and may change without notice. If we discover a pricing or product description error after you order, we may cancel the affected order and refund you in full. We will contact you if this happens.
5. Orders and Payment
When you place an order, you are making an offer to buy the products in your cart. Your order is confirmed only when we send you an order confirmation email, and accepted only when the items ship.
- We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, ordering in quantities that look like reselling, or errors in pricing or availability.
- We accept Visa, Mastercard, American Express, Discover, Apple Pay, Google Pay, and Shop Pay. By submitting payment information, you confirm you are authorized to use the payment method.
- You are responsible for any applicable sales tax, which is calculated and shown at checkout based on your shipping destination.
- All payments are processed securely through our payment providers. We do not store full payment card numbers.
6. Shipping and Delivery
We currently ship within the United States only, including Alaska and Hawaii. Shipping methods, costs, processing times, and delivery estimates are described in our Shipping Policy, which is part of these Terms. Delivery dates are estimates, not guarantees, and risk of loss passes to you once your order is delivered to the carrier.
7. Returns, Replacements, and Refunds
If your item arrives damaged, defective, or incorrect, we will make it right. The full details - including what is and isn't eligible, the 30-day claim window, and how to file a claim - are in our Return & Exchange Policy, which is part of these Terms. Items purchased at a discounted or sale price are final sale.
8. Optional Delivery Protection
At checkout you may add optional delivery protection. If you purchase it and your package is lost, damaged, or stolen in transit, our support team will help you file a claim through our delivery protection partner. If you do not purchase protection, claims for lost, stolen, or carrier-damaged packages are handled directly with the carrier. See the Shipping and Returns policies for details.
9. Promotions, Discounts, and Pre-Orders
From time to time we offer promotions, discount codes, and pre-order products.
- Promotions and discount codes may have their own terms, can be changed or ended at any time, and cannot be combined unless we say so.
- Pre-order items ship on the timeline shown on the product page. Placing a pre-order authorizes us to charge your payment method at the time of purchase unless the product page states otherwise.
10. Intellectual Property
The Site and its contents - including text, graphics, product descriptions, photography, layout, and design - are owned by or licensed to House of PepsiCo and are protected by intellectual property laws. All brand names, logos, trademarks, and product designs are the property of their respective owners, including PepsiCo and its affiliated brands, and are used under license. Nothing on the Site grants you any right to use any trademark, logo, or copyrighted material without the prior written permission of the owner. You may not copy, reproduce, resell, or commercially exploit any part of the Site or its products without our written consent.
11. Acceptable Use
When you use the Site, you agree not to:
- Use it for any unlawful purpose or in violation of these Terms.
- Attempt to gain unauthorized access to the Site, other customers' information, or our systems.
- Interfere with or disrupt the Site, introduce malicious code, or scrape or harvest data using automated means.
- Place orders that are fraudulent or intended for resale.
- Submit content that is unlawful, infringing, abusive, or misleading.
We may suspend or terminate your access to the Site if you break these rules.
12. Customer Content
If you submit reviews, photos, comments, or other content to us or the Site, you grant House of PepsiCo a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our store and marketing. You are responsible for the content you submit, and you confirm you have the right to share it. We may remove any content at our discretion.
13. Third-Party Links and Services
The Site may link to or rely on third-party websites and services, including payment processors, shipping carriers, and our delivery protection partner. We are not responsible for the content, policies, or practices of third parties. Your use of their services is governed by their own terms.
14. Disclaimers
The Site and our products are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, House of PepsiCo and Apparel Consulting Group, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of your use of the Site or your purchase of any product. Our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be limited under applicable law.
16. Indemnification
You agree to indemnify and hold harmless House of PepsiCo, Apparel Consulting Group, LLC, and our affiliates, officers, and employees from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Before filing any formal claim, you agree to first contact us at support@houseofpepsico.com so we can try to resolve the issue informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to venue there.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our products, the law, or our practices. When we do, we will update the "Last updated" date below. Significant changes take effect when posted, and your continued use of the Site means you accept the updated Terms.
19. General
If any part of these Terms is found to be unenforceable, the rest stays in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, make up the entire agreement between you and House of PepsiCo regarding your use of the Site.
